Tema Moda Full Terms & Conditions

Information on how to enter and the prize forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
The Promoter is TEMA MODA PTY LTD (ABN 83 667 659 378) of 17 Walsh Avenue, Maroubra NSW 2035 (“Promoter”).
If you are an Eligible Person and satisfy all Entry Requirements, then subject to these Terms and Conditions, you will be entered into the prize draw to win a prize (“Promotion”).

Entries into the Promotion open at 9:00am (AEST) on Friday, 29 August 2025 and close at 11:59pm (AEST) on Sunday, 14 September 2025 (“Promotional Period”).

Eligibility and Entry

2. Entry to the Promotion is only open:

(a) to permanent Australian Residents aged 18 years or older, excluding employees (and their immediate families) of the Promoter and agencies associated with this Promotion (Eligible Person). All entrants must read and consent to these Terms and Conditions as a condition of entry into the Promotion. For the purposes of these Terms and Conditions, “Australian Resident” means a person who resides in Australia at the start of the Promotion Period and who holds Australian citizenship or holds an Australian permanent residency visa. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin; and

(b) during the Promotional Period, enter into the Promotion by sending an email to us at info@temamoda.com.au and confirm that you would like to be added to onto our newsletter data-base. In turn, you will be added into the draw for a chance to win 2 tickets to our event.

Eligible Applications

3. Multiple entries into the Promotion are not permitted. Entrants can only enter in their own name. When an Eligible Person satisfies the Entry Requirement in paragraph 2 above, that Eligible Person will be entered into the Promotion. For the avoidance of doubt, the maximum number of entries for each Eligible Person who has satisfied the Entry Requirements during the Promotional Period is one (1) entry into the Promotion per Eligible Person.

4. The use of automatic entry software, mechanical or electronic devices that allows an individual to automatically enter the Promotion is prohibited and may render all entries submitted by that individual invalid.

Prize Draw

5.1 There will be one (1) draw with one (1) winner selected at random.
5.2 The total prize pool is valued at approximately AUD $600+ $250.
5.3 The prize consists of:
A 4-hour chauffeured Ferrari Purosangue drive for up to 3 passengers, including pick-up and drop-off at the Four Seasons Sydney, valid Monday–Thursday only, within a 20km radius of Sydney CBD; and
A $250 Tema Moda voucher, valid for 6 months from the date of issue, single use, non-transferable, and not redeemable for cash.
5.4 The following are not included in the Prize: meals, personal expenses, insurance, transport to and from the Four Seasons Sydney pick-up/drop-off point, or any other ancillary costs not expressly stated as included.
5.5 The Prize is subject to the standard terms and conditions of Astra Limousine and Tema Moda, and must be redeemed within the stated validity period.
9. Liability
9.1 The Promoter shall not be liable for any loss, damage, or injury whatsoever which is suffered (including, but not limited to, indirect or consequential loss) or for personal injury which is suffered or sustained in connection with the Prize, except for any liability which cannot be excluded by law.
10. Prize Conditions
10.1 The Prize is not exchangeable or redeemable for cash.
10.2 Unless expressly stated otherwise, all costs associated with redeeming or enjoying the Prize — including but not limited to transport to and from the Four Seasons Sydney pick-up/drop-off point, meals, insurance, and personal expenses — are the sole responsibility of the winner and their invited passengers.
11. Taxes
11.1 Eligible Persons are not required to be present at the draw.
11.2 The Promoter accepts no responsibility for any tax implications that may arise from the Prize.
11.3 All taxes payable as a consequence of receiving the Prize are the sole responsibility of the winner.
11.4 Any additional costs involved in using or redeeming the Prize are the responsibility of the winner.
12. Draw
12.1 The draw will be conducted by the Promoter at 17 Walsh Avenue, Maroubra NSW 2035 at 10:00am (AEST) on Tuesday, 16 September 2025.
12.2 The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
12.3 In the event of war, terrorism, pandemic, state of emergency, or disaster, the Promoter reserves the right to cancel, terminate, modify, or suspend the Promotion or the Prize, subject to any requirements of a relevant regulatory authority.
13. Additional Costs
13.1 Any costs associated with redeeming or participating in the Prize that are not expressly stated as included are the responsibility of the winner.
14. Final Decision
14.1 The Promoter’s decision is final and binding, and no correspondence will be entered into.
15. Winner Notification
15.1 The winner will be notified in writing via the contact details supplied by the Eligible Person when they entered the Promotion.
15.2 The winner will be notified within two (2) business days after the draw.
15.3 The winner’s name will be published on the Promoter’s official Instagram and Facebook pages.
16. Unclaimed Prize
16.1 If the winner does not satisfy these Terms and Conditions or cannot be contacted within a reasonable timeframe (no less than 7 days after notification), the entry will be deemed invalid.
16.2 A redraw will then be conducted at the same place as the original draw on Tuesday, 23 September 2025, to distribute the unclaimed prize.
17. Verification of Entries
17.1 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including identity, age, and place of residence).
17.2 The Promoter reserves the right, in its sole discretion, to disqualify any entrant who:
Has breached these Terms and Conditions;
Has tampered with the entry process; or
Has engaged in unlawful or improper misconduct designed to jeopardise the fair and proper conduct of the Promotion.

17.3 Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
17.4 The Promoter’s legal rights to recover damages or other compensation from such offenders are expressly reserved.
18. Invalid Entries
18.1 Incomplete, indecipherable, or fraudulent entries will be deemed invalid.
19. Disputes
19.1 If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

General

20. The Promoter assumes no responsibility for any failure to receive an entry in the Promotion or for inaccurate information by any person or for any loss, damage, or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify the Promotion.

21. As a condition of entering this promotion, each entrant licenses and grants the Promoter and the Businesses and their affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.

22. The Prize is subject to the event venue and ticket terms and conditions. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the Prize.

23. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
(a) to disqualify any entrant; or
(b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

24. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

25.1 The laws ofNew South Wales, Australia apply to this Promotion, to the exclusion of any other law.
25.2 Entrants submit to the exclusive jurisdiction of the courts ofNew South Wales, Australia.
